El panorama generado por la pandemia tiene unas consecuencias a todas luces notables en la dificultad creciente para armonizar las libertades individuales y sociales con las medidas de diverso orden que toman los gobiernos contra el virus. El poder público está limitando muchas libertades, y no está claro hasta dónde se puede llegar. Este debate vuelve al primer plano a propósito de la duración del nuevo estado de alarma, pero ya latía bajo las batallas legales en las que se han visto enzarzados el gobierno del Estado con algún que otro gobierno autonómico, y varios ejecutivos autonómicos con tribunales de justicia.

En este contexto, se echa en falta una influencia real de la abogacía en el proceso legislativo español, especialmente en el inicio de la formulación de las medidas legislativas. Las organizaciones profesionales de abogados no tienen el peso en el proceso en la medida que sería deseable, y que permitiría anticipar buena parte de los problemas que se están generando. Me refiero a la posibilidad de que su opinión cuente en tanto que consultores de medidas legislativas importantes.

La constelación de ideas y de sensibilidades que forman el colectivo profesional de los abogados, todas ellas sumadas, puestas a su debido tiempo sobre la mesa, pueden aportar calidad a la garantía de los derechos de los ciudadanos y al control del deber público. Son profesionales de una disciplina cuyo material son los derechos y las obligaciones, funcionando como interlocutores entre la justicia y los intereses particulares. Eso supone un magma muy rico de conocimiento que debe de ser aprovechado: tienen mucho que decir sobre las garantías y las deficiencias de un proyecto de medida legislativa. Tienen el pulso de la calle, conocen las problemáticas de los ciudadanos de a pie, y su perspectiva puede ser un bálsamo para las fricciones que, de modo creciente y a veces agrio, se están produciendo entre las libertades sociales y los poderes públicos.

En España, los abogados ni son escuchados ni son respetados como deben ser respetados por parte de las instituciones del Estado. The pandemic-related landscape has important consequences for the growing difficulty of balancing individual and social freedoms with the diverse measures taken by different governments against the virus. State power is limiting many freedoms, with no clear end in sight. This debate has come again to the fore because of questions as to the duration of the latest state of alarm, but it was already tangible in legal battles between the state and regional governments and between several regional governments and courts of justice.

With regard to this matter, a real influence of the legal profession on the Spanish legislative process is sorely lacking – especially in terms of the early stages of constructing legislation. Professional organizations that represent lawyers do not exert over the process the influence that would be appropriate and that could anticipate many of the problems that are emerging.  By this I am suggesting that their opinion be taken in to account as consultants for important legislation.

The legal profession has evidenced over time a broad spectrum of ideas and worldviews that could go a long way towards guaranteeing citizens’ rights and controlling state power. The professionals who work in a discipline that deals with rights and obligations, serving as intermediaries between justice and individual interests. This provides them with a rich bed of knowledge that should be taken advantage of: they have much to say about the guarantees and deficiencies of proposed legislative measures. They have their finger on the pulse of society. They know well the problems facing citizens in the real world, and their perspective could serve as a salve for frictions that are increasingly, and sometimes bitterly, arising between social liberties and public powers.

In Spain, lawyers are neither heard nor given their due respect by State institutions. A change in this attitude would do us all some good.[/vc_column_text][/vc_column][/vc_row][:]
