The Rental Payment Obligation for Establishments Forced to Close Due to Health Measures

In the context of the Covid-19 pandemic, the health measures imposed by the government authority have significantly impacted the economy of small and medium-sized enterprises (SMEs) and self-employed individuals in Spain. The suspension of commercial activity as a result of these measures has led to a literal freezing of billing for many of these businesses, facing a lack of liquidity while all their payment obligations, including commercial lease payments, remain in force.

Gabriella Ballesteros and Ernesto Díaz-Bastién, in their article published in Expansión on March 25, 2020, address this issue focusing on how entrepreneurs can face lease payment deadlines under these adverse circumstances. The central concern is how SMEs and self-employed individuals can manage their financial obligations, especially rent, when their ability to generate revenue has been severely restricted for reasons beyond their control.
